These are the terms which apply to all sales by us, Art Pewter Silver Ltd t/a Textile Heritage™ , to you. By placing an order, you are deemed to have accepted these terms. Please read and familiarise yourself with them.

Orders and Acceptance of Orders
Please note that the information about the products (including the descriptions, quantities and price) does not represent an offer by us to sell the products on that basis. It is merely an invitation to you to make us an offer to purchase the relevant products on that basis. Accordingly, all references to 'orders' placed by customers are deemed to be references to offers by such customers to purchase the relevant products from us.

A contract will only be formed upon our acceptance of your order. Acceptance is at our discretion and will depend, amongst other factors, upon the availability of the products ordered and the descriptions, quantities and prices (which include VAT and excise duty at the appropriate rate from time to time) of the products being those which we apply on the date of dispatch of the products you have ordered.
Acceptance will be by us taking steps to deliver the products that you order. The electronic confirmation of the receipt of your order does not constitute an acceptance of that order.

If, after we have accepted an order from you, you wish to withdraw from the contract, then you may do so by informing us no later than 7 working days after the delivery of the products. If you notify us that you wish to cancel the order, we shall reimburse the payment made by you within 30 days of notification. If you notify us that you wish to cancel the order, and we have already delivered the products(s) to you, then you must return the product(s) to us at your own cost. Provided that the product(s) are returned in the same condition as when we supplied them to you, we shall reimburse all sums paid by you for those product(s) excluding any costs of delivery. No penalty will apply in such circumstances.

Payment
Payment in full must be made prior to despatch of the products by one of the methods described below.

  1. Payment may be made by major credit or debit card.(Please note we do not have facilities to accept AmEx payments). In the event of non-authorisation of payment, we will contact the card holder to advise. We are assured by our supplier who provides the system which we use for carrying out debit and credit card transactions over our website, that transfer of information from the customer to us is conducted through secure channels using encryption facilities to prevent access by parties other than those involved in the trading transaction. We do not accept liability for any losses or costs incurred or sustained by customers and/or card holders who transmit such information. Details of our supplier can be provided on request.
  2. Payment may be made on & off-line by printing out the order form and delivery details and thereafter sending the order form to Textile Heritage™ ,3b Colvilles Road, Kelvin, East Kilbride, G75 0RS, Scotland, UK, together with a UK Postal Order, sterling cheque or sterling draft made payable to
    " Art Pewter Silver Ltd ". Please note that we can only accept payment in UK currency.

  3. Credit or debit card payment can also be made by posting the printed order form to us, or by telephoning us on +44 (0)1355 229 446.

Delivery
Delivery will be made by post within 30 working days of receipt of an order by us (subject to events which are beyond our reasonable control).

Deliveries will be made at no extra charge to addresses within the UK. A charge of £2 will be made for each delivery to any address outwith the UK.

Limitation of Liability
If the products which we deliver are damaged, defective or of an incorrect quantity, then provided you notify us within 7 working days of the date of receipt by you, then we will, at our option:

  1. make good any shortage or non-delivery; or
  2. replace or rectify any damaged or defective products; or
  3. refund to you the amount paid by you for the relevant goods.

We shall not be liable to pay any money to you by way of compensation, other than any refund as provided above. In particular, but without limitation, we shall not be liable to you in contract, tort (including negligence) or otherwise for:

  1. any economic loss (including loss of revenues, profits, contracts, business or anticipated savings); or
  2. any loss of goodwill or reputation; or
  3. any special, indirect or consequential losses or damage, in any case whether or not such losses were within the contemplation of the parties at the time of contracting, arising out of any damage, defect or other failing on our part or out of any misuse by any other person of your credit or debit card details unless (a) you have expressly made us aware in writing of the nature and extent of the loss or damage which you may suffer in such situation and (b) we have expressly confirmed in writing that we accept liability for such matters.

Nothing in these terms shall limit any rights you may have as a customer which are not capable of being lawfully excluded or limited, nor shall it exclude or restrict our liability to you for any death or personal injury.

Data Protection
The information that you provide about yourself to us will only be used by us in accordance with our Privacy Policy This includes using your information for the effective administration of this website and to communicate with you.
The Privacy Policy statement does not apply to any third party web sites, to which links may be included on this Website.

Intellectual Property
No permission is given by us in respect of the reproduction or use for any purpose of any brand names, product names, designs or other material shown on this website in which intellectual property rights subsist. Written requests for such use should be made to Textile Heritage Collection .

Severability
In the event that any of the provision of these Terms shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such provision shall to that extent be deleted from the remaining provisions which shall continue to be valid to the fullest extent permitted by law.

Governing Law
These Terms shall be governed by and construed in accordance with Scots law and parties shall submit to the exclusive jurisdiction of the Scottish Courts.
